I can safely say that due to the flexibility and\u00a0cost saving elements which cloud technology provides with its multi-layered and multi-tenant environment, both businesses and consumers today are quicker than ever to adopt the cloud platform\u00a0\u2014\u00a0and this movement is only set to increase.<\/span><\/p>\n

<\/p>\n

And while the fundamental principle behind cloud technology means that it transcends borders due to its inherently distributed nature, it looks like this might pose another issue.<\/p>\n

The enforcement of the Malaysian Personal Data Protection Act (PDPA) 2010 has highlighted an interesting issue concerning data protection and the cloud.<\/p>\n

The PDPA Act 2010<\/b><\/span><\/h2>\n

The Malaysian PDPA Act 2010 caters for the:<\/span><\/p>\n

    \n
  1. protection of an individual\u2019s personal data rights\u00a0<\/span><\/li>\n
  2. protection of the rights of ownership and control of the dissemination of the data in a measured and protected framework<\/span><\/li>\n<\/ol>\n

    A pertinent aspect of the PDPA Act\u00a0\u2014 especially where the cloud is concerned\u00a0\u2014 is the prohibition of transfer of personal data from within Malaysia to third party countries<\/strong> except those specified and gazetted by the Commissioner of the Personal Data Protection Department.<\/p>\n

    \u00a0<\/p>\n


    The Borderless Cloud Frontier<\/b><\/span><\/h2>\n

    As a globalized concept, there are no borders within the cloud. Due to the architecturally diverse nature of the cloud, a common unifying thread is the globalised hosting of cloud platforms across multiple hardwares at distributed locations spread across the world\u00a0\u2014 all unified by the internet as its backbone. <\/span><\/p>\n

    Where data protection is concerned, cloud computing raises a number of interesting challenges.<\/p>\n

    The PDPA Act requires that it is always made clear:<\/p>\n

      \n
    1. where personal data is stored;<\/li>\n
    2. by whom it is processed;<\/li>\n
    3. who is responsible for the data processing.<\/li>\n<\/ol>\n

      But it\u2019s not always easy to know in which country the customers\u2019 data resides in at any given time.<\/p>\n

      \n

      When data is stored outside the country, one might be at risk of violating the PDPA Act.<\/p>\n<\/blockquote>\n

      As the inevitability of the cloud\u2019s influence steadily marches on, one thing that cloud customers can be assured of is that both their customers as well as their own privacy rights as provided for by the PDPA Act 2010 will continue to be upheld. <\/span><\/p>\n
